У статті досліджено правову природу імунітету та проведено розмежування його двох форм – ratione personae та ratione materiae. Порівняльний аналіз застосування імунітету у судовій практиці виявив розбіжності в домінуючих підходах. Розглянуто останні напрацювання Комісії МП ООН – передусім в аспекті винятків з функціонального імунітету в контексті прогресивного розвитку міжнародного права. Міжнародний вимір імунітету відображає превалювання принципу індивідуальної відповідальності над імунітетами та свідчить про пріоритизацію захисту фундаментальних цінностей. Зроблено висновок щодо зазнавання концепцією імунітету на сучасному етапі процесу трансформації.
