У статті висвітлено сутність та процес еволюції поняття «контрольованої іноземної компанії» (КІК), узагальнено та описано рекомендації ОЕСР для визначення типу організації, якій може бути присвоєно статус КІК, розкрито основні рекомендації з формулювання норм податкового законодавства для регулювання оподаткування результатів господарської діяльності КІК у різних країнах. Систематизовано підходи ОЕСР до визначення рівня контролю та контролюючих осіб КІК, на основі чого проведено порівняльний аналіз визначення та правил КІК у США, СК, Польщі та Україні. Запропоновано напрями для вдосконалення вітчизняного законодавства та підвищення ефективності боротьби з ухиленням від сплати податків в Україні в умовах воєнного стану, які відповідають рекомендаціям ОЕСР та дадуть змогу підвищити якість вітчизняного бізнес середовища й оптимізувати податкові надходження до державного бюджету.
