Legal regulation of the real estate market in Ukraine: current state and prospects for reform

The paper examines the current state of legal regulation of the real estate market in Ukraine, analyzes the main legislative acts regulating legal relations in the real estate market, and identifies the key problems that impede the effective functioning of this market. The author identifies areas for further reform of legislation in accordance with the needs of the economy, society and Ukraine's European integration commitments. The purpose of the paper is to form a holistic vision of the real estate market development prospects in the context of the State's transformation and adaptation to the challenges of the modern world. The author analyzes the key legal acts regulating the real estate sector, in particular, the provisions of the Civil Code of Ukraine, the Laws of Ukraine “On Mortgage”, “On State Registration of Real Property Rights and Encumbrances”, “On Land Lease”, etc. It has been determined that the real estate market is an important component of the national economy, playing a key role in meeting the housing, social, and investment needs of citizens and legal entities. Particular attention is paid to the impact of Russia's armed aggression on the dynamics and functioning of the real estate market: destruction of housing, displacement of the population, decline in construction, and migration of investments. The author substantiates the need for comprehensive reform of the legal framework. It was emphasized that the war in Ukraine has turned the real estate market into an unstable and high-risk sector that requires state support, legislative reform, and an integrated recovery strategy in the post-war period. The war became a powerful destabilizing factor that caused a decline in business activity, a decrease in investment attractiveness, and the massive physical destruction of residential and commercial real estate in a number of regions.
