Проаналізовано застосування ст. 14 Конвенції про захист прав людини та основоположних свобод про заборону дискримінації. Звернено увагу на відсутність чіткого визначення поняття "дискримінація" у тексті Конвенції, що ускладнює його тлумачення. Наведено приклади з судової практики, які демонструють різні підходи до тлумачення вищезазначеного поняття. Також автором розглянуто такі форми дискримінації: пряму, непряму, дискримінацію за ознакою асоціації, а також позитивні дії. Висвітлено необхідність врахування особливостей конкретних ситуацій для винесення справедливого та обґрунтованого судового рішення.
