Передусім наголошується на основоположності «права на надію» довічно ув’язненої особи в аспекті фундаментальної людської цінності – гідності особи. Здійснено тлумачення «права на надію» у контексті ст. 3 ЄКПЛ та практики ЄСПЛ. Зауважено на важливості дотримання повноцінної реалізації покарання у розумінні виправлення засудженого, що обумовлює формування «права на надію». Акцентовано на наявних національних інструментах звільнення особи від відбування міри покарання у вигляді довічного позбавлення волі. Також проаналізовано відповідність даного механізму ст. 3 ЄКПЛ крізь призму практики ЄСПЛ. Зокрема розглянуто справу «Петухов проти України» та досліджені основні зауваження і настанови Суду стосовно національного механізму реалізації «права на надію».
