Досліджено правову природу принципів рівності та змагальності у кримінальному процесі, їх співвідношення. З’ясовано проблеми їх реалізації на рівні Кримінального процесуального кодексу. Досліджено можливість вирішення цих проблем шляхом запровадження інституту приватного детектива в Україні. Проаналізовано Проєкт Закону «Про приватну детективну діяльність» з метою з’ясування його недоліків та перешкод у забезпеченні цим інститутом позитивного впливу на реалізацію принципів рівності та змагальності у кримінальному процесі. Для цього здійснено порівняння його положень із відповідними положеннями законодавства США, Франції, Великої Британії з метою пошуку шляхів удосконалення законопроєкту та запропоновано відповідні зміни до нього.
