Проаналізовано існуючі підходи до визначення цифрового активу серед науковців. Аналіз показав, що єдиного підходу до визначення віртуальних активів та криптовалют наразі не існує. Наявна підміна понять у дефініції та пропонована тема потребує доопрацювання науковцями–практиками. Окрім цього, аналізуються наявні законопроєкти, що мали на меті врегулювання правовідносин стосовно обігу, зберігання, володіння, використання та проведення операцій за допомогою криптовалюти. Визначаються основні чинники застосування ефективних регулятивних підходів до здійснення операції з криптовалютою. Доводиться, що створення прозорої та ефективної системи регулювання правовідносин у сфері застосування віртуальних активів має призвести до позитивного інвестиційного клімату в Україні.
