Статтю присвячено питанню правового регулювання діяльності з відсічі збройної агресії проти України. В основу дослідження було покладено Конституцію України, Закон України «Про оборону України», інші нормативно-правові акти які визначають підстави, порядок відсічі збройної агресії, у т.ч. стосуються компетенції повноважних суб’єктів у зазначеній сфері. Висловлено позицію про необхідність у вдосконаленні правових механізмів прийняття рішень про загальну або часткову мобілізацію, введення воєнного стану в Україні або окремих її місцевостях, застосування Збройних Сил України, інших військових формувань, утворених відповідно до законів України, а також про оголошення стану війни у разі збройної агресії проти України або загрози нападу на Україну включно із встановленням особливої (скороченої) процедури усунення Президента України з поста, у випадку його бездіяльності щодо відсічі військової агресії, а також встановлення кримі-нальної відповідальності за вказані дії.
