Мета роботи: дослідити тему посмертного донорства та розглянути правові моделі правового регулювання вилучення органів від померлих осіб − «презумпція згоди» та «презумпція незгоди», які склалися в світовому співтоваристві. Методи дослідження: документального аналізу і синтезу, порівняльного аналізу, об’єктивної істини, пізнавально-аналітичний та ін. Результати: з’ясована практика застосування кожної з правових моделей трансплантації органів від померлого донора. Обговорення: сучасний стан національного правового регулювання трансплантації органів від померлого донора.
