У статті представлено результати дослідження сучасної концепції судового захисту прав інтелектуальної власності. Акцентовано на наявності праць з тематики дослідження, виконаних у рамках різних галузей юриспруденції. Підкреслено, що основна маса досліджень прав інтелектуальної власності та окремих аспектів їх судового захисту зосереджується у рамках цивільного права, однак не менш важливими є дослідження господарсько-, кримінально- та адміністративно-правового характеру. Відзначено, що міжгалузевий характер інституту прав інтелектуальної власності позначився на розвитку міждисциплінарного судово-правового підходу до вирішення проблем забезпечення цих прав. Акцентовано на важливості наукового осмислення правового статусу Вищого суду з питань інтелектуальної власності. Підкреслено важливість врахування європейського досвіду судового захисту прав інтелектуальної власності у контексті процесів європейської інтеграції України.
