У статті досліджено проблеми застосування санкції за ст. 325 Кримінального кодексу України (ККУ) у сучасній судовій практиці. Проаналізовано нормативні зміни під час дії карантину COVID-19 та їх темпоральні наслідки, що зумовили неоднозначність правозастосування. Розглянуто особливості призначення штрафу, пробаційного нагляду, відсутність додаткових покарань. Зроблено висновок про необхідність викладення ст. 325 ККУ в новій редакції задля забезпечення правової визначеності та ефективної протидії порушенням у сфері громадського здоров’я.
