У статті проведено дослідження доктринальних джерел стосовно визначення сутності адміністративного договору як інструменту діяльності місцевих органів публічної адміністрації. Зазначено, що адміністративний договір визначається як заміна адміністративного акту або як інструмент публічної адміністрації, що застосовується у сферах організації надання послуг з перевезення, зв’язку, комунальних послуг, здійснення передачі (делегування) окремих публічних послуг приватним особам або розпорядження публічним майном, або для усунення невизначеності щодо прав та обов’язків сторін адміністративно-правових відносин на основі компромісу. Водночас в адміністративно-правовій доктрині склалися такі підходи до визначення поняття та природи адміністративного договору – формальний (адміністративний договір як правовий акт), функціональний (адміністративний договір як регулятор) та комплексний.
