У дослідженні зроблено спробу формування сутності сучасного розуміння права на справедливий суд через призму мінімальної гарантії на правову допомогу. Зважаючи на це, проаналізовано найважливішу, ключову та сучасну практику Європейського суду з прав людини з розгляду звернень стосовно порушення мінімальної гарантії на правову допомогу в контексті порушення права на справедливий розгляд, її узагальнення, а також виявлення ризиків такого підходу, а також сучасне концептуальне бачення таких трансформації з погляду правознавців.
