У статті розглянуто загальнонаукові підходи до визначення принципів цивільного права, що регламентують сутність самих правовідносин та їх соціальну спрямованість. У загальнонауковому контексті принципи цивільного права розуміються як його керівні ідеї та вихідні положення. Доведено, що є два розуміння принципів цивільного права: вузьке – це законодавчо визначені засади цивільних правовідносин, широке – засади цивільних правовідносин, які містяться не лише у законодавстві, а також вироблені судовою практикою та доктриною. Обґрунтовано пріоритетність широкого розуміння принципів цивільного права.
