Статтю присвячено дослідженню питанню поділу корпоративних прав подружжя. Проаналізовано наукові підходи до визначення поняття корпоративних прав подружжя, розкрито зміст та особливості презумпції спільної сумісної власності. Акцентовано, що майно, яке перебуває у спільній сумісній власності чоловіка та дружини та яке передане до статутного капіталу юридичної особи, переходить у власність останньої і перестає бути об’єктом спільної сумісної власності подружжя, натомість один з подружжя отримує корпоративні права, а інший – право вимоги. У рамках питання про правовий режим корпоративних прав подружжя здійснено екскурс до судової практики за визначеною проблематикою.
