У статті розглянуто різні аспекти правового забезпечення приватних та публічних закупівель. Розглянуто підходи до визначення та розуміння приватних закупівель порівняно з публічними закупівлями, а також особливості їх здійснення. Запропоновано власне визначення «приватних закупівель» як процедури придбання приватним суб’єктом господарювання товарів, робіт, послуг, необхідних для повноцінного та ефективного функціонування. Проаналізовано деякі елементи процесу закупівель як у приватних, так і в публічних закупівлях, таких як проведення тендерної процедури та подальше укладання договору, звертаючи увагу на їхню юридичну природу та особливості умов та учасників задля досягнення чіткого розуміння цих понять, які в подальшому можуть допомогти у забезпеченні ефективного правового регулювання закупівельних процесів у всіх сферах господарської діяльності.
