У статті визначено зміст предмету умисного введення в обіг (випуску на ринок України) небезпечної продукції. Кримінальний кодекс України передбачає відповідальність за умисне введення в обіг (випуск на ринок України) небезпечної продукції, тобто такої продукції, що не відповідає вимогам до безпечності продукції, які встановлено нормативно-правовими актами, якщо такі дії вчинено у великих розмірах. Вимоги до безпечності харчових продуктів містяться у Законі України «Про основні принципи та вимоги до безпечності та якості харчових продуктів», а до нехарчової продукції – у технічних регламентах, національних стандартах України та інших технічних специфікаціях.
