Дії росії на території України порушують принципи та норми міжнародного права, тому виникає потреба в оцінюванні можливостей отримання Україною репарацій та вивченні цього інструменту міжнародного правосуддя у частині притягнення до відповідальності за скоєні воєнні злочини на території України. Метою статті є дослідження сутності та особливостей репарацій Україні, як інструмента притягнення до відповідальності росії з метою відшкодування втрат і збитків за скоєні воєнні злочини на території України. Результати дослідження може бути застосовано у процесі формування правового механізму відшкодування втрат за умови визнання воєнних злочинів на території України геноцидом українського народу.
