Статтю присвячено дослідженню змісту поняття фраудаторного правочину та визначенню його характерних ознак, наслідків визнання таких правочинів недійсними, а також перспективи розвитку й удосконалення нормативно-правового регулювання у сфері визнання правочинів недійсними. Сформульовано поняття фраудаторного правочину та визначено основні характерні ознаки таких правочинів. Обґрунтовано необхідність закріплення поняття фраудаторного правочину в законодавстві України та формування єдиної концепції в правових підходах до визначення підстав визнання фраудаторних правочинів недійсними.
Ключові слова : правочин, фраудаторний правочин, недійсність правочинів, фіктивність правочинів, загальні засади цивільного законодавства
