Статтю присвячено дослідженню археологічної спадщини як предмета злочинного посягання, уточненню термінологічного апарату. В ході дослідження всі наявні на території України об’єкти археологічної спадщини поділено на три групи: 1) відомі об’єкти археологічної спадщини; 2) передбачувані об’єкти археологічної спадщини; 3) невідомі об’єкти археологічної спадщини. Визначено, що правова охорона забезпечується відомим об’єктам археологічної спадщини, які щойно виявлено або тим, які існують у вигляді пам’ятки національного або місцевого значення, тобто об’єктам, яким держава надала правового статусу «об’єкта археологічної спадщини». Запропоновано внести зміни до чинного законодавства з метою превентивного захисту не лише об’єктів археологічної спадщини із чітко визначеним правовим статусом, а також тих, що його не мають.
