Principles of administrative and legal protection of intellectual property rights: European dimension in the digital environment

The paper addresses the current issue of administrative and legal protection of intellectual property rights in the digital environment, taking into account the European dimension. The author notes that the rapid development of digital technologies, along with the instant and widespread dissemination of intellectual property objects, poses new challenges for the legal system, especially in preventing and stopping violations of copyright and related rights. In this context, defining and systematizing administrative and legal principles that ensure effective protection of the interests of rights holders, users, and internet intermediaries becomes particularly important. The paper thoroughly analyzes three key principles: the responsibility of internet intermediaries, technological neutrality, and the digital economy and innovation. The principle of intermediary responsibility is examined through the lens of Ukrainian legislation (specifically Article 58 of the "Copyright and Related Rights Act") and European case law, including the case "L’Oréal versus eBay", which helps define the boundaries of platforms' duties regarding content moderation. The principle of technological neutrality is understood as a guarantee of equal conditions for the development of various technologies without discrimination, as enshrined in such Ukrainian laws as the "Electronic Communications Act" and the "Electronic Identification Act." Finally, the principle of the digital economy and innovation emphasizes the need for a balance between protecting intellectual property rights and stimulating innovative development, reflected in the "Act on Stimulating the Development of the Digital Economy" and the Strategy for Digital Development and Innovation Activity up to 2030. Based on the work conducted, the conclusion is made about the advisability of further implementation of European approaches into national administrative law, which will contribute to the formation of a modern, flexible, and effective model of intellectual property management in the digital era.
