У статті досліджено правову природу обов’язку органів досудового розслідування доводити невинуватість особи нарівні з виною як прояв реалізації принципу презумпції невинуватості. Проаналізовано норми КПК України та практику ЄСПЛ, визначено концептуальні й галузеві проблеми правозастосування, запропоновано шляхи вдосконалення судового контролю та механізми запобігання обвинувальному ухилу в досудовому провадженні.
