У статті досліджено проблему визначення поняття «штучний інтелект» (ШІ) у праві України. Показано, що відсутність уніфікованої дефініції породжує нормативну асиметрію: законодавець вже регулює наслідки діяльності алгоритмів, але не окреслює саму систему, що їх продукує. Проаналізовано наукові підходи до визначення статусу ШІ: об’єктний, суб’єктний і змішаний – розкрито їхні переваги та ризики. Окрему увагу приділено співвідношенню української Концепції розвитку ШІ та європейського AI Act, де визначення ґрунтується на автономності та адаптивності систем. Обґрунтовано необхідність вироблення юридично функціональної дефініції, яка фіксуватиме відмежувальні критерії та стане основою для гармонізації з правом ЄС.
