Статтю присвячено аналізу понять «відмова від виконання правового обов’язку» та «бездіяльність» у кримінальному праві України, визначенню критеріїв їх розмежування та виявленню проблем правозастосування. Об’єктом дослідження є ознаки цих форм поведінки, предметом – їх об’єктивні та суб’єктивні характеристики. Застосовано діалектичний, формально-логічний, системний, порівняльно-правовий та конкретно-соціологічний методи. Встановлено, що відмова має активний і демонстративний характер, а бездіяльність – пасивну форму невиконання обов’язку. Запропоновано рекомендації з уніфікації підходів у судовій практиці та законодавчого закріплення дефініцій.
