У статті досліджено такий архаїчний вид квазісудового органу, як мировий суд у контексті перспективи впровадження інституту мирових суддів в Україні з метою розвантаження судів загальної юрисдикції та розвитку альтернативних процедур вирішення дрібних правопорушень і спорів. Проаналізовано історичний досвід, іноземні моделі, конституційно-правові обмеження, сучасний погляд науковців та представників суддівського корпусу. Зроблено висновки про умови, за яких мирове суддівство може бути адаптоване до української правової системи без шкоди для принципу верховенства права та суддівської незалежності.
