У статті розглянуто основні міжнародні договори в зазначеній сфері, проаналізовано процедурні механізми подання патентних заявок, зокрема систему пріоритету, що дає заявникові змогу зберігати дату першої заявки під час подання документів у декількох країнах, а також проблематику гармонізації критеріїв патентоздатності й виключень з патентування. Окрему увагу приділено тлумаченню норм міжнародних договорів через прецедентну практику, що зокрема стосується визначення меж патентного захисту біотехнологічних винаходів та фармацевтичних препаратів. Наведено приклади судових рішень, які конкретизували застосування норм міжнародного патентного права, демонструючи як національні суди адаптують загальні положення договорів до особливостей правової системи окремих держав.
