Застосування контролю за вчиненням злочину і виконання спеціального завдання з розкриття злочинної діяльності організованої групи чи злочинної організації в розслідуванні організованої злочинності

У статті досліджено особливості одночасного застосування двох форм негласних слідчих (розшукових) дій: контролю за вчиненням злочину та виконання спеціального завдання з розкриття злочинної діяльності організованої групи чи злочинної організації. Проаналізовано судову практику, законодавчі положення та наукові підходи до правової природи таких дій. Обґрунтовано доцільність їх комплексного застосування як взаємодоповнюючих інструментів боротьби з організованою злочинністю та надано рекомендації з дотримання процесуальної форми їх реалізації.

Ключові слова : контроль за вчиненням злочину, виконання спеціального завдання, організована злочинна група, конфіденційне співробітництво
