У статті досліджено сучасний міжнародний досвід застосування медіації як ефективного інструменту альтернативного вирішення спорів. З огляду на зростаючу потребу у швидкому та менш конфліктному способі врегулювання правових суперечок, медіація набуває дедалі більшого значення в різних країнах світу. Проаналізовано ключові міжнародно-правові документи, які регулюють правові засади функціонування медіації, зокрема Директиву 2008/52/ЄС, Сінгапурську конвенцію про медіацію, Типовий закон ЮНСІТРАЛ, рекомендації Ради Європи та Європейську хартію з підготовки медіаторів. Особливу увагу приділено порівняльному аналізу практики застосування медіації в США, Німеччині, Франції, Польщі.
