Liability for violation of legislation in the production and circulation of cement in Ukraine

The paper examines regulatory legal acts that provide for liability for violations of legislation in the production and circulation of cement in Ukraine as one of the key segments of the industry, which affects economic stability, competitiveness of the building materials market, quality of infrastructure development and the level of construction safety. The relevance of the topic is due to the growth of construction volumes in the conditions of military and post-war reconstruction of the state, the spread of cases of sale of low-quality and counterfeit products, non-compliance with technical regulations, as well as the need to increase the efficiency of state supervision. The system of liability in the studied area is complex and covers administrative, economic and legal, civil and criminal spheres. The practical significance of the results obtained lies in the possibility of their use in regulatory activities, the practice of regulatory bodies and business entities, as well as in the scientific and educational process. The system of bringing to justice for violations of legislation in the production and circulation of cement in Ukraine clearly regulates this area within the framework of existing legislation and the circumstances that have developed in the market of building materials, taking into account the consequences of military aggression against Ukraine. However, there is also an understanding that this system of legislation needs to be improved: strengthening the institutional capabilities of regulatory bodies; improving the system of certification and traceability of products; increasing the personalized responsibility of market entities; adjusting the sanction policy taking into account the economic feasibility of violations, as well as further harmonization with European standards in the context of the recovery of the Ukrainian economy.
