Land as an object of contractual legal relations in the legislation of the leading states of the world

The paper reveals the role and problems of determining the features of land as an object of contractual legal relations in the legislation of the leading states of the world as one of the conditions for building a modern democratic society. It is determined that the effective use of state resources is often the key to its economic success and the well-being of its citizens. One of the key resources for any state is its land. The value of land as a national wealth lies in its multifunctional purpose. In the states of the world, the issues of regulating land relations have their own characteristics, determined by historical, geopolitical, social, and economic factors of the development of a particular state. Some states are trying to keep up with such global transformations by making changes to their own legislation, while other states are trying to get ahead of global changes, that is, they are making additions to the legislation in order to initiate or accelerate the development of relevant legal relations. The peculiarity of the regulation of land relations by its nature is that it combines legal, economic and environmental aspects that determine the use, protection and circulation of land as an object of real estate, while simultaneously ensuring the stability of property rights, the efficiency of land resources use and ensuring the interests of society. It is also important to highlight the role of civil legislation as the basis for the legal regulation of land relations in many countries of the world. It is determined that the protection of land ownership should be considered as a system of methods, methods and means aimed at restoring the violated subjective right of ownership to land directly by the owner or an authorized entity, as well as the process of their implementation. It is proven that in the legislation of the leading countries of the world, land is considered as an object of a complex interdisciplinary institution of property rights, which is regulated, guaranteed and protected by various branches of law.
